21 Shifts Terms and Conditions

These Terms and Conditions ("Terms") govern your use of 21 Shifts, a restaurant new-hire training and certification platform operated by Electric Eel Consulting LLC ("we," "us," "our"). By accessing 21 Shifts through a link provided to you by your employer, or by receiving SMS messages from us, you agree to these Terms.

SMS program summary. 21 Shifts sends operational and training-related SMS messages to enrolled restaurant employees. Message frequency varies based on your training schedule — typically one to three messages per scheduled shift. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for support. We do not share your mobile number with third parties for marketing purposes.

1. Eligibility

21 Shifts is intended for restaurant employees aged 16 and older who have been enrolled by their employer. You may not access the platform if you are under 16 or if you have not been authorized by a participating restaurant.

2. How Enrollment Works

Your employer enrolls you in 21 Shifts during new-hire orientation. Your employer collects your name, mobile number, and role, then provides this information to us to set up your training. You receive a unique training link via SMS that you use throughout your 21-shift training program.

3. SMS Messaging Program

Description of service. 21 Shifts sends operational SMS messages to enrolled new hires, trainers, and managers. Message types include training links, shift reminders, quiz prompts, re-quiz notifications, certification confirmations, and trainer handoff briefs.

Consent. By being enrolled in 21 Shifts by your employer and providing your mobile number, you consent to receive these SMS messages. Your consent is not required as a condition of employment unrelated to training delivery — you may opt out at any time without losing your job, though your employer may need to deliver training to you through alternative means.

Frequency. Message frequency varies. Most new hires receive between one and three messages per scheduled shift across a 21-shift training program.

Rates. Message and data rates may apply. Check with your mobile carrier for details.

Opt-out. Reply STOP to any message to unsubscribe. You will receive one final confirmation message. To re-subscribe later, reply START.

Carrier disclaimer. Carriers are not liable for delayed or undelivered messages. We do not guarantee that every message will reach your device.

All training content delivered through 21 Shifts — including modules, quizzes, scenarios, and certification materials — is the property of Electric Eel Consulting LLC and/or the participating restaurant. You may not copy, redistribute, or republish this content outside the platform without written permission.

6. AI-Generated Content

21 Shifts uses artificial intelligence (Anthropic's Claude models) to generate training content, grade quizzes, and provide coaching scenarios. While we work to keep content accurate and current, AI-generated material may occasionally contain errors. Always defer to your restaurant manager and trainer for authoritative guidance on policies, procedures, and operational standards.

7. No Employment Relationship with Electric Eel

21 Shifts is a tool provided by Electric Eel Consulting LLC to participating restaurants. Your employment relationship is solely with your restaurant employer, not with Electric Eel. We do not make hiring, firing, scheduling, or compensation decisions.

8. Privacy

Your use of 21 Shifts is governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

21 Shifts is provided "as is" and "as available." We do not warrant that the platform will be uninterrupted, error-free, or completely secure. Training completion through 21 Shifts does not by itself guarantee job performance or continued employment, both of which are determined by your employer.

10. Limitation of Liability

To the maximum extent permitted by law, Electric Eel Consulting LLC will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of 21 Shifts. Our total liability under these Terms is limited to the fees, if any, you have paid to us directly (which, for restaurant employees, is typically zero).

11. Termination

We may suspend or terminate your access to 21 Shifts at any time at the request of your employer or for violation of these Terms. You may stop using the platform at any time by replying STOP to SMS messages and ceasing to open training links.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in Denton County, Texas.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to enrolled users and restaurant administrators via email or SMS. The "Last updated" date at the top reflects the most recent revision.
